N O P E, in that sense you can say spy is OP.
Spy can invis, hiding himself from others
He can also get instant kills by simply backstabbing (Which is 180 degrees in TF2)
Spy has deadringer, "a crutch"
All for the price of low health

Actually, the classes are not equal. Scout IS the most op class. He has huge damage, huge mobility, only at the downside of low health, which can be negated by his innate ability to dodge.
